Sirumalai PazhathottaVivasyigal Sangam District, DuraisamyBoopathy vs. The State of Tamil Nadu, Dept of Forest and Environment and Ors.  MANU/TN/2603/2011

Notification of Lands as Reserve Forest Present writ petitions impugned order of first Respondent State notifying alleged lands as reserve forest and sought to set aside same and also to further forbear Respondents from notifying lands in survey numbers contained in proceedings of Forest Settlement Officer, as reserve forest till resettlement proceedings were completed by second Respondent. Held, Petitioners had failed to prove any violation of procedure by department in issuing impugned notification challenging in two sets of writ petitions, They had also failed to establish any legal or enforceable right on their part for getting relief as prayed for by them Successfully they were involved in forum shopping and were attempting to get orders from Court to prolong their illegal occupation in forest land. Certainly, Court would not be a party to encourage Petitioners’ attempt to derail orders of Supreme Court. Under these circumstances, there was no case made out by Petitioners – Accordingly, all writ petitions dismissed.
